The charge of abuse or neglect must be proven at a fact-finding hearing held in Family Court. If the case is not proved, the child must be returned to the parent or guardian. If the court finds that abuse or neglect occurred, it may issue an order requiring the removal of the child from the home for a period of up to twelve months.

The order may also direct the parent or guardian to participate in programs and services designed to help eliminate the problems that caused the abuse or neglect. Appeals must be filed within certain time limits set out in the legislation or court rules that apply to the case. A party may request that the public authority provide information to the parties and court regarding child support payments.
